Employee Settlement Agreements (previously called Compromise Agreements) are legally binding agreements. In employment, they are usually used to formally end the employment contract between an employer and employee.
For an employment settlement agreement to be valid, the employee must have received advice from an independent legal adviser, such as a solicitor. The solicitor signs what is called an adviser’s certificate as part of the process.
Under a settlement agreement, an employee cannot bring a claim in the Employment Tribunal. Therefore, it is important to get the right legal advice before agreeing to the terms of a settlement agreement.

Employee settlement agreement solicitor fees
Settlement agreements for senior employees or where the termination payment exceeds £25,000, are usually more detailed or complex. In such cases, we will discuss and agree a bespoke fee arrangement with you before carrying out any work.
For simple or straightforward settlement agreements, your employer will typically agree to pay a contribution to your legal fees. This is usually a minimum of £350 plus VAT for obtaining advice on your settlement agreement.
If not, we can negotiate with your employer to seek payment of your legal fees as part of the agreement if you wish.

For a fixed fee from £420 (£350 plus VAT) we will review your settlement agreement and advise you on the terms it contains and provide the adviser's certificate. If you are not sure that the offer from your employer as part of your settlement agreement is sufficient, we can usually advise you on your options for a fixed fee of £149 inc VAT. This fee will be payable by you.
If you decide that you want us to try and negotiate a better settlement offer on your behalf with your employer (or their solicitor), we can normally do this for a fixed fee of £600 including VAT. This fee will be payable by you.
