Employee Settlement Agreements

We are here to help you reach a settlement agreement with your employer. One that takes your specific circumstances into account, with as little stress, cost, and uncertainty for you.

Employee Settlement Agreements (previously called Compromise Agreements) are legally binding agreements. In employment, they are usually used to formally end the employment contract between an employer and employee.

For an employment settlement agreement to be valid, the employee must have received advice from an independent legal adviser, such as a solicitor. The solicitor signs what is called an adviser’s certificate as part of the process.

Under a settlement agreement, an employee cannot bring a claim in the Employment Tribunal. Therefore, it is important to get the right legal advice before agreeing to the terms of a settlement agreement.

If you have been offered a settlement agreement we can help you.

Employee settlement agreement solicitor fees

Settlement agreements for senior employees or where the termination payment exceeds £25,000, are usually more detailed or complex. In such cases, we will discuss and agree a bespoke fee arrangement with you before carrying out any work.

For simple or straightforward settlement agreements, your employer will typically agree to pay a contribution to your legal fees. This is usually a minimum of £350 plus VAT for obtaining advice on your settlement agreement.

If not, we can negotiate with your employer to seek payment of your legal fees as part of the agreement if you wish.

We can help you for a fixed fee

For a fixed fee from £420 (£350 plus VAT) we will review your settlement agreement and advise you on the terms it contains and provide the adviser's certificate. This fee will usually be paid by your employer. Simply call Burnett Barker Solicitors on 01284 701131. You can also send us a message, or pop in and see us at 20 Whiting Street, Bury St Edmunds - just make sure you call us ahead of your visit.
